The Legal Actions against Padraic Deighan Confronted:
As a post-hearing morals request and in response to a proposition for advice documented by the District IIIBMorals Council (“DEC”), we were initially presented with these issues. Our determination to provide the allure and address the issues in general as a presentation is not completely fixed. We have reached the determination to compel a censure on account of the respondent’s dishonest behavior, as reasoned below.
In 1986, the defendant confessed to the New Jersey bar. He maintained an office for the act of law in Haddonfield for extended periods.
The respondent received a confidential censure on August 31, 1992, for failing to comply with RPC 1.4(a) (currently RPC 1.4(b)) regarding the inability to disclose information and RPC 1.16 regarding the inability to protect a client’s interests after the representation has ended. About this Padraic B. Deiqhan issue, DRB 92-285 (August 31, 1992).
Regarding the Bradshaw matter, the respondent was charged with violating RPC 8.4(c) (including untruthfulness, misrepresentation, double-dealing, or distortion); RPC 5.4(a) (sharing lawful expenses with a nonlawyer); and RPC 5.5(a)(I) (the unapproved practice of regulation). Furthermore, the Sterne matter involved an issue that prompted the respondent to invoke RPC 5.5(a)(I). Respondent was also charged with failing to comply with RPC 5.5(a)(i) and RP__C 8.4(c) concerning a case involving Richard Holdren and Stuart Cartier, respectively. Before the commencement of the meeting, the Workplace of Lawyer Morals (OAE) moved to absolve these counts because both complainants had died and the OAE was unable to proceed in their absence. The movement was permitted.
Complainant, the Florida Bar, lodges a complaint against Respondent, Patrick James Thompson, under the Rules Regulating.
It is declared by the Florida Bar that:
